Norwegian authorities seized the Russian cruise ship Professor Molchanov in the Arctic archipelago of Svalbard on behalf of Ukrainian energy company Naftogaz, which seeks to enforce a $4.22 billion compensation award related to Russia’s 2014 annexation of Crimea. The vessel was taken in Barentsburg, a Russian-operated coal mining settlement, under the terms of a 1920 treaty governing Svalbard. An arbitration court in The Hague ordered Russia to pay Naftogaz $4.22 billion plus interest and legal costs in April 2023, a decision Russia rejects as lacking jurisdiction. Naftogaz’s acting CEO, Sergii Fedorenko, emphasized that Russia cannot evade responsibility by refusing to comply with the international arbitral award. The ship, capable of carrying 32 crew and 52 passengers, was docked in Barentsburg for a scientific expedition when it was seized. Norway indicated it would facilitate the safe return of crew and passengers if desired, while Naftogaz, represented by U.S. law firm Covington, anticipates further legal challenges from Russia but views the seizure as a significant victory toward recovering the owed compensation ¹.
